This is my position, and as always, I refuse to compromise on matters of principle.

Dry heat, I was wondering why someone like myself of modest means post a real picture of myself in my profile ? When someone like yourself says there correct and preaches his so called beliefs to us has to post a cartoon picture ? Why do you hide your identity ? Are you afraid ? Are you ashamed ? Are you more comfortable in the dark were no one can see you ? Maybe you had a tragic childhood ? Maybe you know your not popular to the masses ? Your words have NO meaning for a coward that hides from everyone.....

If you really believe this crap you preach then show yourself and stop hiding like a coward ! I am sure now you will reply with this and that and all your twisted words to justify not showing yourself BUT were not that stupid Sir.... time to come out of the closet so to speak dry heat ! Yes, you got me- I am afraid that you are a 6'6" 250 pound MMA fighter. Honestly, I don't care who you are- never did. As much fun as this forum is, I know some allow their emotions to run wild when frustrations sets in. Since I have other project in penasco that I have some involvement in, I certainly don't want some nut job to affect a project or others involved in them because he/she did not like what I said on an online forum. So yes, Mr tough guy to help you feel better tonight- just answer yes to your questions about me.

I am not here to preach, I don't care to convert anyone in what I have said. I really states 3 main things on this thread. 1. owners cannot rent outside of the rental operator 2. the resort will always have an exclusive rental operator (no different than any other resort) 3. a new operator will take over the existing one hopefuly this year. It is certainly not my job to enforce the covenants and restrictions.

It seems to me that you have much deeper issues. My guess is you are needing to collect ever penny you can on your unit in order to hang on to it- regardless of the means. Stating what I said above is obviously going against your desperation. I am sorry for your struggles, however resorting to desperate measures or actions is never good business. Like I said before, maybe it's best to walk away from the debt and enjoy life. Some things are not worth hanging on to if they bring us heartache, especially material things. Wish you the best- coward little boy (another nickname to add this week).

I am sure your Filipina mail order bride business is doing well and maybe that should be your focus. I personally think it should include tours of massage businesses in the phillippines- that is an instant income increase.

Definately, you will find countless units on site such as VRBO that offer an owner approved rate of $145 (lowest approved owner rate for a 1 bedroom ocean view unit). The only additional amount you will pay is the 5.5% mexico lodgings tax and associated fee's (total weekend rate per night is $152.97). no wristband fee's, no check cleaning fee, daily maid service, full hotel service (ie. move you to another unit if you have a problem, etc.).

Weekday rate would be $115 per night. I think you will find these prices are lower than those offered at othere resorts along sandy beach, plus (of course my biased opinion) the resort is a better product.
Do you think these prices are too high for the market?
Hopefuly with a new rental operator and association operator, the overal product will improve.

Look, if you don't like how something is done in real estate you have a few options (sell, foreclose, change the bylaws). I dont' work for the resort, so I don't have to answer to you (you are not my employer). I don't care who you are nor have I ever paid attention to your picture. I was actually more interested in "happy ending" massage services in the philipines and was wondering if your "personal tours" included this, or is the tour service more to find me a filipino wife? Sorry I digress again... I don't care to tell you who I am because I have nothing to due with your rental frustrations, plus I am more concerned about some fruit loop getting pissed and starting problems for my ventures in penasco. Since you clearly want to rent your unit on your own and want to collect all the rental income, I suggest you start a grass roots campaign and contact all your owners and work to change the bylaws. I only stated that, it appeared based on your strong feelings and frustrations, that you desperately needed to rent your unit on your own without paying anything to a rental operator. It just seemed to me that something else was influencing your passionate frustration. By the way, thank you for making it clear that you are not stupid, not desperate and your emotions are fine. I am happy for you.

I'm in the Lear halfway across. Yes, I realize you had it reserved for Tuesday but our interests in Lybia are taking a pounding and someone needs to intervene. The value of the rest of the portfolio has dropped by some 35%, since most of it is in the Middle East. I warned about that 5 years ago you might recall. Can't complain too much as we are still up over 600% in that time.

Have you staff contact my staff to work out the details of the merger we spoke about late last week. Tio M. won't be able to help us this time so you're the expert on this and it's in you hands.

We need a new security company as well, these guys are just not working out. Had an incursion in my perimeter last week in NYC, not a pretty sight.

On the yacht deal, Tatoosh is on the market at $176 but that's too rich for me right now. I know you like Columbus 177 at $34 but I'm still stuck on Alibi. Sacanu designs the best and the interior by Luca Dini is to die for.

When is the next meeting? The Russias are getting jumpy again so maybe Moscow.

Claro que si. Hemos tenido inversiones en Penasco. Pero lo peor es de Las Palomas. He construido casas en Penasco ,pero nunca he visto ladrones como ellos en Las Palomas.

As a suggestion you may want to include such things as you are an employee who works for a corporation that has revenue's of so many millions. The oversight of millions in property or working at a college? Hey, I think you are a superstar. I too would tell others about it while fishing in penasco or during long story nights. Funny thing is, I don't think I have ever said what I do for a living, however I assume you have made an assumption based on various comments I have made over the years. Either way, I guess you are more interested or think some words are impressive. Maybe it's a big deal to some.

This forum is a riot to read. There are serious questions being asked, people are looking for answers, expressing their different ideas and giving their opinions. When someone doesn’t agree there are some that resort to cutting them down and it reminds me of when I was in grade school many years ago. Remember when 2 kids would be going at it and saying the funniest stupid stuff about each other and when they would finally shut up and look around all of the kids were looking at them and laughing? Well that us laughing at you, you guys are really funny. I have always enjoyed people (kids) who find the need to cut others down who they differ with just to make them feel better about themselves. Please keep it up I can’t wait each day to read who has resorted to their play ground antics again. But again this is just my opinion.

Unfortunately some don't like the way things are or the update regarding the resort (intent of of this thread). I posted countless times the latest updates regarding the resort (new rental operator, new HOA administrator, negotiations regarding debt owed) and answered questions regarding the rental rules of the resort (current bylaws, what is needed to change bylaws, reasons why a resort has only 1 operator, examples of resorts that have only 1 operator). Some don't like the answers and start to get emotional about it and say such things as "who do you think you are" "I can do as I please" "owners group representing owners has their own agenda" and on and on. Eventually anger sets in and frustration and then a little group gets together and wants to start spreading rumors and insults to help their disagreement with the way things are and wanting to hold an owner accountable for their problems. In the end, I cop to playing along with the playground games only for the purpose of entertainment after listening to countless complaints, rumors and insults. In any case, if it the games continue so be it. If the conversation steers more toward the topic then even better!

I totally believe that you oversee millions in property and that you work for a college at the same time, I am sure that the millions you oversee are yours and not others. I am sure it is nothing like a secretary for an investment brokerage saying she oversee's billions. I have no doubts that "many people on this forum" will vouche for your claims of your oversight business and know the exact details of your million +++ operation.

I am glad your boss allows you to work from home. I hope you spend the time working and not thinking about another man bending over for you- I don't want you to lose your employee perk of working from home.

Back to the topic. Anyone here caught Las Palomas renting their condo when it was blocked or sneaking people in without acknowledging same to the owner? I have. There is now a site that reports lights on in condos at night to curb this tactic.
Also , summertime is coming so lock your AC compessor cabinets or there will be stuff missing.
I notice they are locking the doors to access those. Kelpinc's services help.

I recently had Kelpinc instal the eTemp temperature controls in my 2 bedroom unit. It helps with restricting guests from lowering the a/c down to 69 degrees in the summer time (door sensors also help).

good question, problem is the rental company can only rent units who have a contract with them (the contract is between the owner and the rental company- not the HOA). The HOA does not have anything in their bylaws that give them permission to audit the rental operators business. If another resort was able to have the HOA audit the rental operator's business, I would love to hear about it and find out how they went about it or the reason they used. So, to answer your question directly- I have not heard of the rental company being audited by the HOA for their financials or performance with owners.

I assume the complex is one of the milllions in property you oversee- very nice. However, I am worried that you would post a picture of your weener if someone said it was 4 inches. Or am I losing something here.....who is the "for profit side" of Las Palomas???? What prevents the rental company from being ousted? They have defaulted on their contracts with the individual owners by not paying them for the rental of their units.

Since the owners are having issues with the performance of the Operator, the owners need to remove the operator by following sonoran law and following HOA bylaws when it comes to removing and replacing the existing operator with another. So yes, the existing operator can be removed or ousted by the owners who have a contract with them (not by the HOA). the HOA can only enforce one rental company, the cancellation or removal of the rental company must be done by the owners who have a contract with the operator. the owners are currently in this stage (removing the operator and replacing with another).

So...the rental company has a contract with the resort....isn't that the HOA???? Or is "the resort" some other entity? Are you also saying that the owners who do not have a contract with the rental company also have no say as to who is or is not the exclusive rental agent? That is what you're implying.

The rental operator has an exclusive contract with the HOA.
The only owners that can remove the rental company are those that have a contract with the rental company (owners who do not have a contact with the operator cannot vote to remove them).
The HOA though has strict guidelines for the services and requirements of what the chosen rental operator must bring to Las Palomas in order to meet the HOA's standards (ex. AAA 4 diamond rated level for a hotel).

Checked all those same docs and there is no guest of owner $5 daily fee. The CC&R's do mention a renter HOA fee, but no mention of a guest of owner fee.

The SC gets away with implementing these types of policies because they depend on owners ignorance or the fact that they are just checked out.

Seems to me the Secret Squirrels had a bit of a discussion concerning their "right " to restrict all others to 6 days per month of friends and relatives staying at YOUR home.They agreed that it needed a vote but implemented it anyway.Can those of you that read this and don't own there believe the audacity of these guys? My suggestion is to approach the entity that sent you the correspondence. If you are still upset about the results, I suggest you start a grass roots campaign to accomplish your wishes. You guys are just wasting time barking online, if you want something done it will require action.

Its amazing how drymeat avoids answering questions...Now as soon as a few owner pull out there contracts and other papers drymeat doesn't seem to like information sharing and he is tired now.... good go take nap drymeat you must be very tired from running everyone in circles with useless answers that help no one....wow you could run for politics drymeat.... I want you guys to have as much fun as I do. So here is a fun project. Find out who the restrictions of use affect. Read the Operator agreement. Read the latest HOA bylaws (don't go off the one you purchased on since addendums and such have been added, changed, removed over the years in the form of general assembly meetings). After your research, contact a mexican contract attorney and follow up on your questions. If you feel you have something to go on, then contact the rest of your fellow owners and present the information with the intend of changing something. It will require a lot of work, but I am fully confident you guys can do it. Based on the passion you show here, I know the two of you will enjoy the work.

The "entity" that issued these new mandates, as reported in a mass e-mail from ALP on March 7th, consisted of SC, TC, OLP and ALP representatives, as a result of meetings that occurred throughout the week-end of 3/4, all agreeing to, among other things, restrict owners' rights to the use of their properties, both within and outside of the rental pool. The SC and /or TC reps absolutely not only assisted in facilitating these changes, they INSTIGATED them.

For a 2 bedroom ,about $300 a month. So 800 units with 3/4 paying, they collect $600 per day. That chlorinates alot of pools and cuts alot of grass considering what they pay there.

Are you sure you are quoting the mass e-mail from ALP correctly. You may want to read what the SC does in your bylaws. I could give you the answer, but I am sure you will believe it more if you read it yourself. You are wasting your time here, if you want action get to it and so something. bitching and crying over your frustration gets you no results. Andale amigo!

3/4 of the units don't pay $300 per month.
Read your bylaws to find out what the maintenance fee's include.

Some right, some wrong, some more complicated than the statement made, some are standard in the industry. Yes, you are missing a lot more when it comes to your recap.
I know the SC had to hire an attorney in mexico city because they could not find one in the penasco area that did not already have some conflict of interest with the developer.

sorry, SC stand for suveillance commitee (made up of individual owners- roughly 15 between both phases). Truthfuly, I don't have the energy to expand on each point and then deliberate for countless posts. I have already wasted waaay too much time on here.
My purpose on this thread was to provide what I know regarding "Las Palomas update". I stated how things are and the plan for the immediate future. For those that disagree with either, I suggest they do something about it rather than vent on an online forum. Most of these issues have already been expanded on tirelessly within the owner group of Las Palomas. I wish owners who want action on their issues or concerns the best of luck in getting it accomplished.

The restrictions were sent by Hector who represents WWG in cooperation with the TC (tourist committee) members. You can be excused for confusing the SC (surveillance committee) with the TC as the Phase II SC and TC have many interchangeable parts.

I really feel for the owners at Las Palomas (one of my friends owns/lives there full time)....but I think that all of this "airing" of the mess should help those that may be considering buying there......

Rockyptjoe, don't get me wrong. LP is a great resort, in my biased opinion the best in RP. Hopefully and once the HOA finances get in order, there are many great things to say about LP. However, there are a small number of very active owners that have taken control of the HOA (like many other developments) and they appear to have a single minded pursuit of ensuring no competition with the resort operator. And with every new restrictive rule put in place, they seem unconcerned with the collateral damage and infringement of owners rights. Often, the solutions (limiting guest of owners days) are worse than the original problem (some owners renting on their own).

They have and many do so quite happily. You have many owners who live far away and feel that they have no control of their investments. They were not prepared to invest in a foreign country. They do not have the time or are not interested to get deeply involved so there are happy to have a small group of owners watching out for their interests. Also, as you can see from these trail of posts, the issues seem complex and many owners do not understand the problems nor the implications.

The SC has done a great job in dealing with the big issue, which is regaining control of the finances from WWG. The resort is in a much more stable financial position going forward, despite all other issues. The biggest concern now is recovering for past debt from WWG which is a complex mess that may involve an exchange of assets.

The fact that the SC and TC continues to harp on these side issues is hard to understand and ultimately has side consequences that hurt the owners.

If you goggle her name the whole page has her on it, so I don't think, unlike you, that she has a problem with me showing her picture on here. You assume wrong again Heat, that picture was taken at The Point Hilton Squaw Peak Resort where she was dancing last June. In fact she just got back from a gig in London.. The property I oversea is here in Prescott behind Thumb Butte, and I work in facilities management at Yavapia College. I've also made a deal with my friends to not be called trailer trash, because I sleep under them, not in em, but in my heart.

I am always here for you and proud that you represent a highly esteemed community college. One should not be ashamed of trailer living. It seems that many who own trailers use the phrase often, seems strange.
